Welcome to Busanti Gate Company LLC (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website, www.busantigatecompany.com, and your purchase or use of our products, gate equipment, gate automation components, limited gate service, consultation, and related offerings.

By accessing our website, submitting a request, scheduling service, purchasing products, or using our services, you agree to these Terms. If you do not agree, please do not use our website or services.

1. Services and Products Provided

Busanti Gate Company provides gate products, gate operator equipment, access-control components, custom gate packages, replacement parts, and limited residential gate service in Palm Beach County, Florida, including Loxahatchee, Wellington, West Palm Beach, Boca Raton, and surrounding areas.

Our offerings may include:

  • Gate products, hardware, operators, remotes, keypads, batteries, solar components, and access-control equipment;

  • Custom gate and equipment packages;

  • Gate diagnostics, adjustments, programming, and minor gate service;

  • Battery replacement, remote/keypad support, and solar/battery operator support;

  • Product consultation and gate package planning;

  • Limited qualifying small-scope gate service under $2,500 total.

Busanti Gate Company does not perform 110V/220V electrical work, hardwiring, breaker/panel work, new AC outlet installation, or permit-required electrical work. Larger gate, fence, automation, construction, fire-access, or permit-required projects must be handled by the appropriate licensed professional or authority-approved provider.

2. Limited Small-Scope Gate Service

Busanti may provide limited small-scope gate service where the total job value is less than $2,500, including labor, materials, equipment, fees, delivery, and all other charges connected to the job.

Limited small-scope service may include diagnostics, gate adjustments, hinge/latch adjustment, minor repair, keypad or remote programming, battery replacement, solar/battery troubleshooting, and plug-and-play support where no 110V/220V electrical work is involved.

Busanti does not split projects, divide scopes, or structure separate charges to avoid licensing, permitting, electrical, or code requirements. If a requested project appears to exceed the applicable small-scope service limitation or requires licensed work, Busanti may decline the work, limit its scope, or refer the customer to obtain assistance from an appropriate licensed professional.

3. Product Sales and Customer-Selected Installation

Busanti may sell gate products, custom gate packages, operators, automation components, access-control equipment, hardware, parts, and related materials directly to customers or to licensed contractors.

Unless expressly stated in a written agreement, product sales do not include installation, site work, electrical work, permitting, code compliance, inspections, engineering, zoning approvals, HOA approvals, fire-rescue approvals, or construction services.

Customers are responsible for hiring any required installer, contractor, electrician, engineer, or other licensed professional. If Busanti provides a directory or list of independent installers or contractors, that directory is provided for customer convenience only. Busanti does not recommend, rank, supervise, employ, subcontract, control, or warrant the work of any independent installer or contractor. Customers are responsible for verifying licensing, insurance, pricing, permits, scope, workmanship, and contract terms before hiring any third party.

4. Electrical Work Limitation

Busanti does not perform 110V/220V AC electrical work. This includes, but is not limited to:

  • Breaker or panel work;

  • Hardwiring;

  • Junction box work;

  • New AC outlets;

  • Running AC power;

  • Transformer primary-side work;

  • AC conduit or AC circuit installation;

  • Troubleshooting or modifying AC power supply.

Any required 110V/220V electrical work must be performed by a properly licensed electrician hired directly by the customer or by the responsible licensed contractor.

Certain solar, battery-powered, 12V, or 24V DC gate operator work may be available as limited small-scope service when no AC electrical work is involved and the total job qualifies under applicable limits.

5. Customer Responsibilities

The customer is responsible for:

  • Providing accurate contact information, service location, property access information, gate details, and photos when requested;

  • Confirming ownership or authority to request service at the property;

  • Disclosing known electrical, structural, fire-access, HOA, zoning, or permitting issues;

  • Obtaining HOA approval where required;

  • Obtaining permits, inspections, engineering, zoning approvals, or Fire Rescue/AHJ approvals where required, unless expressly included in a written scope by an appropriate licensed professional;

  • Hiring any required licensed electrician, contractor, engineer, or installer;

  • Ensuring safe site access for Busanti personnel;

  • Securing pets, livestock, vehicles, and personal property before service.

Busanti may decline or stop work if conditions are unsafe, outside the agreed scope, beyond the applicable service limitation, or require licensed work not provided by Busanti.

6. Fire, Emergency Access, HOA, Zoning, and Permitting

Gate and access-control projects may be subject to Fire Rescue, emergency access, zoning, setback, HOA, right-of-way, building, electrical, or permitting requirements.

Busanti does not determine or waive requirements imposed by an Authority Having Jurisdiction, Fire Marshal, HOA, municipality, county agency, utility provider, or other regulatory body. The customer is responsible for obtaining and complying with all required approvals unless a written agreement expressly provides otherwise.

For gates affecting emergency access, driveway access, gated community access, commercial access, multifamily access, or fire apparatus access, additional requirements may apply, including approved key access, emergency release, Knox, Click2Enter, hold-open functionality, or other AHJ-approved systems.

7. Eligibility to Use Our Website and Services

To use our website, submit a request, purchase products, or schedule service, you must:

  • Be at least 18 years old;

  • Provide accurate contact, service, and payment information;

  • Have authority to request service at the property;

  • Comply with these Terms and all applicable laws, rules, ordinances, and regulations.

We reserve the right to refuse, limit, reschedule, or terminate service for fraud, unsafe conditions, abusive conduct, nonpayment, regulatory concerns, scope limitations, or non-compliance with applicable requirements.

8. Quotes, Estimates, and Scope Changes

Quotes and estimates are based on the information available at the time they are prepared. Photos, customer descriptions, site conditions, equipment condition, missing parts, hidden damage, electrical issues, structural problems, access limitations, and regulatory requirements may affect final pricing or scope.

A quote does not guarantee that work can be performed if the actual site conditions require licensed work, permitting, electrical work, engineering, code compliance, or services outside Busanti’s offered scope.

Additional work, materials, return visits, concealed conditions, or changes requested by the customer may require a revised quote or written approval before proceeding.

9. Payments and Billing

Busanti accepts payment by credit card, check, bank transfer, cash, and approved electronic payment methods.

A deposit may be required for product orders, custom materials, equipment purchases, consultations, or scheduled work. Final payment is due upon completion of the agreed service or delivery of products unless otherwise stated in writing.

Credit card payments may be subject to a processing fee of up to 3.5%, where permitted by law. Cash, check, cashier’s check, or bank transfer may be available without a credit card processing fee.

Unpaid balances more than 30 days past due may incur a late fee of 1.5% per month, or the maximum amount permitted by applicable law, whichever is lower. Customer is responsible for reasonable collection costs, returned payment fees, and attorney’s fees where permitted by law or contract.

10. Cancellations, Missed Appointments, and Rescheduling

Customers should cancel or reschedule service appointments at least 24 hours in advance.

Missed appointments, inaccessible properties, locked gates, unavailable decision-makers, unsafe conditions, or cancellations with less than 24 hours’ notice may result in a service fee of up to $150.

Custom product orders, special orders, fabricated items, and ordered equipment may not be cancellable once materials have been ordered, fabricated, modified, or shipped.

11. Returns and Refunds

Custom gates, custom products, special-order items, opened electrical or automation equipment, installed equipment, used products, and fabricated materials are non-refundable unless otherwise required by law.

Unused and unopened stock items may be eligible for return within 14 days, subject to inspection, approval, and a restocking fee. Shipping, handling, delivery, processing, consultation, and service charges are non-refundable unless otherwise stated in writing.

Manufacturer warranty claims are subject to the manufacturer’s terms, exclusions, documentation requirements, and approval process.

12. Customer-Supplied Equipment

Busanti may, at its discretion, service or assist with customer-supplied equipment. Customer-supplied equipment includes products purchased directly by the customer from Amazon, online retailers, other installers, manufacturers, prior owners, or third parties.

Busanti does not warrant customer-supplied equipment, product suitability, missing parts, manufacturer defects, compatibility, installation history, prior wiring, prior workmanship, or product performance. The customer is responsible for manufacturer warranty claims and replacement parts unless otherwise agreed in writing.

If customer-supplied equipment creates safety, compatibility, code, electrical, structural, or operational concerns, Busanti may decline service or recommend that the customer consult the manufacturer or an appropriate licensed professional.

13. Warranty

Busanti provides limited warranty coverage only as stated in the written invoice, proposal, or product documentation.

Limited service labor may be warranted for the period stated on the invoice. Product warranties, if any, are provided by the applicable manufacturer unless Busanti expressly provides a separate written product warranty.

Warranty coverage does not apply to:

  • Misuse, abuse, vandalism, accidents, weather, storms, flooding, lightning, power surges, corrosion, insects, animals, landscaping damage, or acts of God;

  • Customer-supplied equipment;

  • Pre-existing conditions;

  • Structural problems with gates, posts, fencing, columns, walls, foundations, hinges, or mounting surfaces;

  • Electrical failures or wiring not performed by Busanti;

  • Work performed or modified by others;

  • Lack of maintenance;

  • Batteries, remotes, keypads, sensors, or consumable components unless expressly stated;

  • Equipment used outside manufacturer specifications;

  • Unauthorized repairs, modifications, or programming changes.

14. Limitation of Liability

To the maximum extent permitted by law, Busanti is not liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of use, loss of access, lost profits, security losses, property access delays, business interruption, or inconvenience.

Busanti’s total liability for any claim related to products or services shall not exceed the amount paid by the customer to Busanti for the specific product or service giving rise to the claim.

Busanti is not responsible for work performed by independent contractors, electricians, installers, engineers, manufacturers, suppliers, HOAs, municipalities, utilities, Fire Rescue, inspectors, or other third parties.

15. Safety and Operational Responsibility

Automated gates and access-control systems can create safety risks if misused, damaged, improperly maintained, modified, or operated contrary to manufacturer guidelines.

Customers are responsible for safe use of their gate system, maintaining clear travel paths, keeping children and pets away from moving gates, reporting malfunctions promptly, and discontinuing use if the system appears unsafe.

Busanti may recommend safety devices, signage, sensors, photo eyes, edge protection, maintenance, or further evaluation by an appropriate professional. Customer refusal to approve recommended safety work may limit or void warranty coverage and may require Busanti to decline further service.

16. SMS, Calls, and Communications

By providing your phone number, submitting a request, or opting in, you consent to receive calls, emails, and SMS/text messages from Busanti regarding scheduling, service updates, estimates, customer support, and related business communications.

Promotional messages will only be sent where legally permitted and with any required consent.

Message frequency varies. Message and data rates may apply. Consent to promotional messages is not a condition of purchase.

We do not sell or share SMS consent data with third parties for their independent marketing purposes.

17. Privacy and Data Protection

Busanti collects and uses customer information to provide products, service, quotes, scheduling, customer support, billing, and related communications.

We use reasonable administrative, technical, and physical safeguards to protect customer information. No system is completely secure, and customers should avoid sending sensitive information unless necessary.

18. Website Use and Third-Party Links

Our website may include links to third-party websites, manufacturers, payment processors, mapping services, scheduling tools, social media platforms, or independent contractor directories. These links are provided for convenience only.

Busanti is not responsible for third-party content, accuracy, availability, pricing, privacy practices, warranties, services, or conduct.

19. Intellectual Property

All content on www.busantigatecompany.com, including text, logos, images, graphics, designs, product descriptions, videos, layouts, and other materials, is owned by or licensed to Busanti Gate Company LLC and may not be copied, reproduced, distributed, modified, or used without written permission.

Customers may not use Busanti’s name, logo, photos, product designs, proposals, drawings, or materials for commercial purposes without written authorization.

20. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Florida.

Any dispute, claim, or controversy arising from or relating to these Terms, our website, products, services, invoices, or business relationship shall be resolved in Palm Beach County, Florida.

To the extent permitted by law, disputes shall be resolved by binding arbitration in Palm Beach County, Florida. By using our website, purchasing products, or scheduling service, you waive the right to a jury trial and the right to participate in a class action.

Claims that qualify for small claims court may be filed in the appropriate small claims court in Palm Beach County, Florida.

21. Changes to These Terms

We may update these Terms at any time. Changes are effective when posted on our website unless otherwise stated.

Your continued use of our website, products, or services after changes are posted means you accept the updated Terms.
